1. INTRODUCTION

These Terms & Conditions (“Terms”) govern the use of the website 5minaway.com (the “Site”) and the booking and coordination services provided by 5MINAWAY LLC (“5MINAWAY,” “we,” “our,” or “us”).

By accessing the Site or using our services, you (“you,” “Traveler,” or “User”) agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Site or our services.
 

2. NATURE OF OUR SERVICES

2.1 Intermediary Role Only

5MINAWAY provides booking assistance, coordination, and communication services between Travelers and independent accommodation providers (“Lessors”).
We do not manage, own, operate or supply accommodation of any kind.

2.2 No Property Operation

5MINAWAY does not:

• operate hotels, villas, apartments, or any lodging

• act as a landlord, property manager, or real estate broker

• provide maintenance or hospitality services

• guarantee the condition, quality, or availability of any accommodation

2.3 Direct Contract With Local Lessors

When making a reservation, Travelers enter directly into a contract with the Lessor who provides the accommodation.
The Lessor is solely responsible for:

• delivering the lodging service

• ensuring compliance with local laws

• managing check-in, check-out, deposits, and any property rules

• handling any matters related to the property

5MINAWAY is not a party to the rental agreement.

3. PAYMENTS

3.1 Payment Intermediary

Payments collected through the Site for accommodation are received solely as an intermediary on behalf of the Traveler and transferred to the Lessor or its representative.

We do not retain ownership of any accommodation fees.

3.2 Service Fees

5MINAWAY may charge service or coordination fees.
These fees cover administrative, communication, and support activities and are non-refundable, unless stipulated otherwise in writing.

3.3 Security Deposits

Some Lessors require security deposits. These may be:

• pre-authorized on the Traveler’s card, or

• collected directly by the Lessor

Deposit rules, amounts, and refund conditions are determined exclusively by the Lessor.

5MINAWAY does not decide deposit terms and is not responsible for disputes related to deposits.

4. BOOKING PROCESS

4.1 Submission of Request

Travelers may request accommodation through:

• forms on the Site

• email

• direct communication with 5MINAWAY

A booking is not confirmed until:

1. The Lessor accepts the reservation; and

2. Payment is processed.

4.2 Accommodation Information

Descriptions, photos, amenities, and availability are provided by Lessors.
While 5MINAWAY strives to ensure accuracy, we:

• do not guarantee completeness or accuracy

• are not liable for errors, changes, or omissions in the listings

4.3 Traveler Responsibility

The Traveler is responsible for providing:

• accurate personal data

• valid payment information

• correct number of guests

• compliance with property rules

5. CANCELLATIONS & REFUNDS

Cancellation and refund conditions are determined exclusively by the Lessor, not by 5MINAWAY.

5MINAWAY:

• does not set cancellation policies

• does not control refund eligibility

• may assist in communication but cannot override the Lessor’s conditions

Any request for cancellation or modification must follow the Lessor’s rules.

6. LIABILITY

6.1 Limitation of Responsibility

To the maximum extent permitted by law, 5MINAWAY is not liable for:

• the condition, safety, legality, or suitability of accommodations

• acts, omissions, negligence, or misconduct of Lessors

• delays, cancellations, overbookings, or force majeure events

• property damage, accidents, injuries, or losses occurring at the accommodation

• any disputes between Travelers and Lessors

5MINAWAY acts solely as a facilitator, not as a provider of lodging.

6.2 Traveler Acknowledgment

By booking through 5MINAWAY, the Traveler acknowledges that:

• all lodging services are provided solely by the Lessor

• any issues with the accommodation must be resolved directly with the Lessor

• 5MINAWAY is not responsible for the performance of the rental contract
   

7. SITE ACCESS & USE

The Site must not be used to:

• submit false requests

• provide inaccurate information

• attempt to circumvent the booking process

• engage in unlawful activity

We reserve the right to block access for misuse.

8. INTELLECTUAL PROPERTY

All content on the Site, including text, graphics, logos, images, and software, is the property of 5MINAWAY or its licensors and is protected by intellectual property laws.

You may not:

• reproduce

• modify

• distribute

• use content for commercial purposes

without prior written authorization.
 

9. PRIVACY

Personal data is processed in accordance with our Privacy Policy, available on the Site, which includes GDPR and CCPA compliance.
 

10. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any disputes shall be resolved in the competent courts of Miami-Dade County, Florida.
 

11. CHANGES TO THESE TERMS

We may update these Terms at any time.
Changes will take effect when posted on the Site.
